Since The Horizon Group has been acquired by Hypercom and is no longer an independent reseller, VeriFone has terminated its agreement with The Horizon Group. Some customers have been led to believe that The Horizon Group will continue to sell VeriFone products. This will hopefully clear up the confusion in the marketplace.

I've been working with ISOs for a while and now I am seeing problems, because I am in New York, which is a high fraud area. If you can recommend an ISO that will be good for me, that is willing to work with sales agents on every level (including liability) I have no problem taking some liability upon myself. Dear Sir:

A tenant of mine, who owes me money, has offered to pay me this debt with several post-dated checks. Do you see any problems with accepting this offer?

Dear Paul:

Acceptance of post-dated checks is a common method of obtaining payment on an outstanding debt when a debtor lacks sufficient funds at present to honor his or her obligation or as a means of consummating a sale that might otherwise not be made. As a general rule, a post-dated check is treated like any other check.

The UCC (Uniform Commercial Code) states that an instrument payable on demand is not payable before its date. Therefore, a post-dated check remains payable on demand, but not before the date noted on the check. Generally, the fact that a check is post-dated, in and of itself, does not render the check a conditional obligation nor does it have any impact whatsoever on the check's negotiability.

You should be aware, however, that some states have characterized post-dated checks as promissory notes and not checks. Such a determination may make it difficult to seek a remedy under their state's bad check statute should the check be dishonored and thus preclude collection of penalties normally available when collecting upon a bad check.

Why is it that I do my best to make all my merchants happy with their equipment, lease rates, supplies, rates, etc. and after one (or more) of my greedy and un-trainable reps talks to them, I end up being the "bad guy." Are there any honorable processors and or reps in this business?
