The
California Superior Court, County of Los Angeles, Central Judicial
District, granted Electronic Clearing House, Inc. (ECHO) a demurrer (i.e.
no law broken) in four of the seven lawsuits filed against ECHO by
Premiere Lifestyles International Corp., of Newhall, California.
The
surviving causes allege damages of $10 million and include claims for
breach of fiduciary duty, tortious interference with business relations,
and tortious interference with contract. The California lawsuit is
currently in discovery and ECHO's legal counsel feels there is not
sufficient facts to support or justify liability against the Company.
A
similar lawsuit was previously filed in Texas and subsequently withdrawn
by the plaintiff after ECHO filed motions to dismiss.
