It
appears that lawsuits, or threats of lawsuits, may be more lucrative than
the publishing business. For those of you who do not regularly read The
Nilson Report,
a financial services publication from Oxnard, California, I would hope
that it is not because you sometimes have a delay in getting your
photocopy from a subscriber. This act might put the person making the copy
on the receiving end of a copyright lawsuit from The Nilson Report. In
every issue and on every page of this popular report, publisher Spencer
Nilson offers to pay readers $5,000 for anyone reporting a reader who is
reproducing or allowing reproduction of any portion of the newsletter.
In
the March 2000 issue, Spencer Nilson reports that Cardservice
International has been sued for $200,000 in a lawsuit that alleges that
material copyrighted by The Nilson Report appeared on the Cardservice Web
site. The publication also reported that The Nilson Report collected
$150,000 in out-of-court settlements in recent months from others.
In
a subsequent issue (714) The
Nilson Report clarified that no court has yet determined the merits of their suit
against Cardservice and that Cardservice denies violating The Nilson
Report copyright.
